PUBLIC NOTICE
EMERGENCY WATER BAN ORDINANCE
Revised Ordinance - April 2002
Notice is hereby given that the Seabrook Board of Selectmen intends to formally adopt the following emergency ordinance regulating the excessive use of water pursuant to the powers granted in the Seabrook Home Rule Charter and the Revised Statutes of the State of New Hampshire, as amended:
WHEREAS, there exists in the Town of Seabrook a critical shortage of water;
AND WHEREAS, an adequate supply of water is necessary for the public health and safety;
THEREFORE, be it enacted:
PROHIBITION OF THE EXCESSIVE USE OF WATER
The use of municipal water in excess of existing uses and amounts by persons, firms, or corporations is hereby prohibited, and the use of municipal water outside of the primary domicile or place of business other than for drinking, cooking, and hygienic reasons is prohibited. Specifically prohibited is the use of outside hose for the purpose of filling swimming and wading pools, the watering of lawns, trees, shrubbery, or gardens except gardens operated for commercial purposes. The ordinance allows, as an exception, the use of outside faucet to fill buckets/pails for outside watering purposes, but no hoses are to be connected. Outside showers will not be allowed unless fully enclosed similar to and interior bathroom.
Upon notification of a violation of this ordinance the Seabrook Water Department shall have the authority to investigate and to initiate appropriate action.
a.) First violation shall be a written warning.
b.) Next two violations shall receive fines of $100.00 each
c.) Fourth violation shall mean disconnection of the water
service. The reconnection
of the water service shall require approval by the board of selectmen.

The town shall consider property owners the responsible party and
all fines shall be
issued against the owners.

This ordinance shall become effective,
April 17, 2002
until further notice as may be
determined on the advice of the
water department superintendent and/or by the town's
consulting water engineers.
5.
If any provision of this ordinance or any portion of such
provision or the application
thereof to any person or
circumstances is held invalid. the remainder of the ordinance and
the remainder of such provision
and the application thereof to other persons and circumstances
shall not be affected thereby.
